In a strongly worded brief for the United States Supreme Court, the Obama administration has sided with the Vatican in an Oregon lawsuit that names the Holy See as a defendant for its role in the sexual abuse crisis.

In effect, the brief asserts that the standards for an exception to the immunity that foreign governments enjoy under American law have not been met in the Oregon case.

Filed on Friday, the brief stops short of recommending that the Supreme Court directly take up the case of Doe v. Holy See, originally filed in federal district court in Oregon in 2002. Instead, it suggests that the Supreme Court set aside the 2009 ruling of an appeals court that allowed the case to go forward, sending it back for further consideration.

I don’t know whether Obama is afraid that a legal precedent could be set, and that lawsuits may be attempted against other nations AND VICE VERSA ……or that he is afraid of the massive misleading publicity that would ensue. Some Catholics that currently ignore their bishops may pay more attention if the bishops manage to mislead them.

  2. American presidents are paranoid about Americans being held responsible for stuff in other countries. Remember the fuss that the US made about not signing up to international war crime legislation that all the rest of the civilised world were happy to (or, at least thought they were morally obliged to). This is understandable as the US is the biggest war criminal by far of recent years.

    Obama promised to protect George W. from prosecution and allowing the prosecution of Vatican officials would make that promise harder to keep.

  3. You mean that the majority of the Supreme Court of the United States are foreigners? Hopefully, they have their greencards handy if they visit Arizona.

  4. Perhaps this is why the Mafia have got away with so much for so long in the US. It’s the diplomatic immunity. And cynical me thought it was bribery and corruption.
